User Agreement – ​​Maxcom Tracker eSIM

1. Introduction

This User Agreement ("Agreement") governs your use of the Maxcom Tracker eSIM application and related services. Please read this Agreement carefully before using the application. By registering an account, logging in, or using the application, you accept all terms and conditions.

If you do not agree to the terms, you may not use the app or services. If you are under 18, please review the Agreement with a legal guardian.

2. Scope of services

The Maxcom Tracker eSIM application allows you to:

  • GPS and Wi-Fi location,
  • voice and video calls,
  • chat messages,
  • remote device management,
  • content publishing and social communication.

The Services may be updated, expanded, or modified without prior notice. You have the right to accept or decline updates; failure to accept may limit your access to features.

3. Account registration

  • The user registers an account using their phone number and sets a password.
  • The account must be legal – impersonating other people, using offensive names, and mass account registration are prohibited.
  • The account may not be transferred, loaned or sold without the written consent of the provider.
  • The user is fully responsible for any actions performed using his or her account.
  • If you lose your password, you can regain access by verifying your phone number.

4. Personal data protection

  • During registration and use of the application, personal data is collected (e.g. name, phone number, location).
  • Data is processed in accordance with the Privacy Policy and applicable law.
  • The user has the right to access, correct, delete data and withdraw consent.

5. User Content

The User undertakes not to publish content:

  • illegal (e.g. incitement to violence, pornography, hatred),
  • violating the rights of others (e.g. image, privacy, intellectual property),
  • misleading, offensive, spammy.

The Provider has the right to remove content that violates the rules and block the accounts of users who violate the Agreement.

6. Intellectual property rights

  • The User declares that he or she has the rights to the content he or she publishes.
  • You grant the Provider a non-exclusive, perpetual license to use this content within the App and related services.

7. Risk and responsibility

  • The Services may be temporarily unavailable due to technical or unforeseen reasons (e.g. network failures, force majeure).
  • The Provider is not liable for any losses resulting from interruptions in the operation of the application.
  • The user uses the application at his/her own risk and undertakes to comply with the law.

8. Advertising and external content

This app may contain advertising and content from third-party partners. You are responsible for your purchasing decisions and interactions with ads.

9. Changes to the Agreement

The Provider reserves the right to update this Agreement. We will notify users of any changes in the app or on the website. Continued use of the app after any changes constitutes acceptance of the new terms.

10. Final provisions

  • The contract is subject to Polish law.
  • Disputes will be resolved by the court having jurisdiction over the registered office of the supplier.
  • If any provision of the Agreement proves invalid, the remaining provisions shall remain in force.
