1.Introduction

We invite you to use the software and related services provided by ShenZhen Anquanshouhu Tech Co., Ltd. (next " Maxcom Tracker " " my " or " nose ").

The software and related services ("our services") we provide to you refer to the client application branded "Maxcom Tracker" legally owned and operated by us, including but not limited to core features such as location queries, video calls, instant messaging, remote device management, personalized recommendations, information posting, interactive communication, and other features. Maxcom Tracker is a tool-based application and content service platform for home users. The Maxcom Tracker User Agreement ("this agreement") is an agreement between you and us regarding your registration, login, and use (collectively, "use") of our services.

To provide you with better services, please read this Agreement carefully and fully understand it before using it, especially the clauses regarding the exclusion or limitation of liability, licensing and use of information, consent to activate and use a special single service, applicable laws and dispute resolution, etc. Of these, you should focus on reading the clauses in bold, such as exclusion or limitation of liability. If you are under 18 years of age, please read and fully understand this agreement with your legal guardian and use our services before receiving verifiable consent from him or her.

By accessing or using our Services, you agree to be bound by these Terms. Otherwise, you may not access or use our Services. If you agree to or use our services, you are deemed to have already read and agreed to be bound by this Agreement and the Service Agreement and Policies of other related software, including, but not limited to, the Privacy Policy.

2.Maxcom Tracker and related services

2.1 You may obtain our client application through pre-installation, download through authorized third parties, etc. when you intend to use our services. If you did not obtain the software through the method we mentioned, we cannot guarantee that the unofficial version of the software can be used normally, and the loss you suffer is insignificant to us.

2.2 We may create different versions of the app for different end devices. You should obtain, download, and install the appropriate version based on your device's actual device status. If you no longer use our services, you can uninstall the corresponding app.

2.3 To provide you with a good experience, we will update or change our Services from time to time (including, but not limited to, software modifications, upgrades, functional improvements, the development of new services, software replacements, etc.). You can update to the appropriate version based on your needs.

To ensure the security of our services and improve the user experience, when we partially or fully update our services, we will remind you in appropriate ways, including but not limited to system prompts, announcements, website notifications, etc., and you have the right to choose whether to accept the updated version. Otherwise, some features of our services will be limited or you may not be able to use them normally.

2.4 Unless you have obtained prior written consent from us, you may not make unauthorized access to or use our services in any form, including but not limited to adaptation, reproduction, distribution, vertical search, mirroring or trading, etc.

2.5 You must provide your own end devices (such as mobile phones, tablets, etc.) to use our services. Once you open them on your end device, you are deemed to have used our services. To fully utilize the software's features, you may need to connect your end device to a network, and you will be responsible for any associated costs (such as data charges, internet access fees, etc.).

2.6 We grant you a personal, non-transferable, non-exclusive, non-commercial, limited license to use and access the Services solely as permitted in these Terms. We reserve all rights not expressly granted to you in these Terms. Except for the rights permitted through the Services or otherwise authorized by us in writing, your license does not include any right not mentioned by us. Furthermore, our failure to exercise any of the aforementioned rights does not constitute a waiver of that right.

2.7 You are not required to register to use our services, but core features or services will be affected. In the meantime, we hope you understand that to enhance your experience with our services, protect the security of your account, and some features and/or individual services (such as the commenting service) will require you to provide real personal information and register under your real name before using them in accordance with applicable national laws and regulations.

  1. Your account

3.1 Our services provide you with a registration channel. You have the right to choose a legal character combination for your account and set your own password that meets security requirements. The account and password you set are your credentials for logging in and using our services.

3.2 You understand that the account you create must not violate national laws and regulations or our relevant policies, and you must not engage in any activities that violate national interests, harm the legal rights and interests of other citizens, or harm public morality. Please ensure that your username, avatar, profile, and other people's information are lawful, and you must not use someone's name without permission (including, but not limited to, impersonating another person's real name, image, etc., in a manner that causes confusion). You must not register your account maliciously (including, but not limited to, frequent and mass registration, etc.). We reserve the right to review the information you submit.

3.3 Only you have access to your Maxcom Tracker account. You may not transfer, lend, rent, assign, sell, or otherwise allow others to use your account without our prior written consent. If we discover or have reasonable grounds to suspect that you were not the original user of the account, we may suspend, terminate, or immediately cancel your account to protect the security of your account.

3.4 You are solely responsible for the information associated with your account and everything that happens in connection with your account, including, but not limited to, any changes to your information, comments, payments, and other activities. You must maintain the security of your account and notify us immediately if you discover or suspect that someone has accessed your account without your permission.

3.5 If you've forgotten your password, you can follow the instructions to recover it. We'd just like to remind you that using mobile number verification is preferred, as security is paramount. You must keep your account and password safe. We assume no responsibility if it's hacked or lost due to your own reasons.

3.6 When using your account, please remember the relevant information you have entered (such as your account number, password, security questions, etc.). In accordance with applicable national laws and regulations, we may be required to provide real personal information (such as identity authentication) to use certain features of our Services, and you should ensure that you update relevant information in a timely manner. If the content you submit or the information you provide is inconsistent or incompatible, we have the right to refuse to provide you with related features, and you may not access or use our Services.

3.7 In addition to registering with Maxcom Tracker, you are also permitted to use other legal software, including but not limited to our and/or our partner software and third-party software user accounts registered under real names, to log in and use Maxcom Tracker, except where the third-party software or platform restricts or prohibits this. When logging in using the aforementioned existing account, you must ensure that the corresponding account is registered under your real name, and the same applies to this Agreement.

3.8 Not only can you log in and use Maxcom Tracker, but you can also use your login account for other software and services provided by our affiliated companies. We remind you that when you log in and use the aforementioned services using your Maxcom Tracker account, you will be bound by the User Agreement and other terms and conditions of the relevant provider.

3.9 To enhance content visibility and publishing efficiency, we may automatically publish all content created through your account or the corresponding account on this software/website to other software and websites operated by us and/or our partners. Your posting, editing, and deletion of content on this software/website will be synchronized with the other software and websites listed above. When you register or log in to products and websites operated by us and/or our partner companies (if any) using your registered account or third-party software user account, you must comply with the software's and website's own User Agreement and other terms and conditions.

3.10 After completing registration, logging in, and completing reasonable and necessary verification of your Maxcom Tracker identity, you may review and modify the personal information you submitted at any time. You may not be able to modify the initial registration information and other verification information you provided during registration due to security and identity reasons (such as account or password recovery services, etc.). You may request deletion of your account, and we will assist you after completing reasonable and necessary verification of your personal identity, security status, device information, etc., except as required by law.

3.11 To ensure you get the most out of your account, if you do not log in to your account for the first time within the timeframe following registration or have not used your account for more than six months, we will recover your account.

  1. Protection of user personal data

We work with you to protect your personal data (which, alone or in combination with other information, can identify you). Protecting your personal data is one of our fundamental principles. To provide you with better service and appropriate technical support, you may be required to provide personal data (including, but not limited to, your name, phone number, location information, etc.) when using Maxcom Tracker. We will use encryption, anonymization, and other technical and security measures consistent with Maxcom Tracker to protect your personal data. We will also collect certain other information about you in accordance with the Privacy Policy.

  1. User Code of Conduct

5.1 User Behavior Requirements

You will be responsible for anything that happens in connection with your Account while using our Services. Except as permitted by the Services or otherwise permitted by us in writing, your license does not include the right to:

5.1.1 Use any third party plug-ins, systems or tools that are not authorized or licensed by us to disrupt, destroy, modify or otherwise affect the normal operation of our services.

5.1.2 Take any action against our services that may compromise the security of a computer network, including but not limited to:

(1) Illegally intruding into other people's networks, disrupting other people's normal functions, stealing network data and other activities that threaten network security;

(2) Provide programs and tools specifically designed to break into networks, disrupt normal network functions and security measures, and steal network data, etc.

(3) You know that others are taking actions that threaten network security, continue to provide assistance in the areas of technical support, advertising promotion, payment settlement, etc.;

(4) Use unauthorized data or access unauthorized servers/accounts;

(5) Access public computer networks or other people's computer systems without permission and delete, modify or enhance stored information;

(6) Attempt to detect, scan, or test the vulnerability of the Maxcom Tracker system or network without authorization, or otherwise engage in any activity that may undermine the security of the network;

(7) Attempting to disrupt or interrupt the normal operation of the Maxcom Tracker system or website, deliberately spreading malicious programs or viruses, and other activities that disrupt and interfere with the normal operation of information services on the network;

(8) False TCP/IP packet name or partial name;

(9) Reverse engineer, disassemble, reverse compile or otherwise attempt to discover the source code of our Services;

(10) Maliciously register accounts for our services, including, but not limited to, frequent and bulk registrations;

(11) Violation of laws, this Agreement, our applicable policies, and other actions that infringe upon the rights and interests of others.

5.1.3 If we have reason to believe that your actions violate or may violate the above agreement, we will be able to independently assess and address the matter and will have the right to terminate the service to you without prior notice and pursue appropriate legal liability.

5.2 Content Specification

5.2.1 Once you have completed your registration in accordance with the terms and conditions, you can log in to Maxcom Tracker using your registered account or our partner platform account to post content, track comments, etc.

5.2.2 We are committed to making information sharing and commentary civilized, rational, friendly, and high-quality. While promoting the development of information sharing, interactive communication, and commentary businesses, we will continue to strengthen appropriate information security management capabilities, improve the self-discipline of information sharing and commentary posting, and effectively fulfill social responsibilities, comply with national laws and regulations, and uphold the legitimate rights and interests of citizens and social order.

5.2.3 The content you comment on, post and publish should consciously comply with these requirements, such as laws, regulations, social order, social morality, the socialist system, national interests, legitimate rights and interests of citizens, moral customs and authenticity of information, etc. You agree and promise not to produce, copy, publish or distribute the following information that is prohibited by laws and regulations:

(1) Those who fight against the fundamental principles established in the Constitution;

(2) Persons threatening national security and disclosing state secrets;

(3) They undermine state authority, overthrow the socialist system, incite secession and undermine national unity;

(4) Persons harming national honour and interests;

(5) People supporting terrorism and extremism;

(6) Supporting national hatred, national discrimination and the destruction of national unity;

(7) Incitement to regional discrimination, regional hatred;

(8) Destroying national religious policy and promoting cults and superstitions;

(9) Persons creating and spreading rumors and false information, disturbing the economic and social order and social stability;

(10) Persons promoting violence, obscenity, pornography, gambling, murder, terror or inciting to commit a crime;

(11) Violating the rights and legal interests of minors or causing damage to their physical and mental health;

(12) Persons who photograph or record other people without permission, thereby violating their rights;

(13) Containing horror, violence, high-risk content, threatening one’s own physical and mental health or the health of other people;

(14) Persons who threaten network security and use the network to jeopardize national security, honor and interests;

(15) Persons who insult or slander others, violating their rights;

(16) These violent intimidations, threats and body searches against others;

(17) Concerning personal privacy, information or data;

(18) People spreading bad words that harm the social order;

(19) Persons violating privacy, reputation, image rights, intellectual property rights, etc.;

(20) Persons disseminating commercial advertisements or similar commercial offers, marketing messages and spam;

(21) People commenting in a language other than that commonly used on this site;

(22) Having nothing to do with the information being commented on;

(23) Persons publishing information that is meaningless or deliberately using combinations of characters to avoid technical controls;

(24) Violating laws, regulations, rules, social order, disrupting our normal functioning or infringing the legitimate rights and interests of other persons or third parties.

5.3 We have established a public platform for complaints and reports. You can submit complaints to us through our public complaint system, such as any type of illegal activity, illegal communication activities, illegal and harmful information, etc. We will promptly receive and address your feedback to work together to create a cleaner online environment.

  1. Information Content Specification

6.1 Without our written consent, you may not authorise, permit or assist any third party to do any of the following based on the information contained in our services under this agreement:

(1) Copy, download and use information content from Maxcom Tracker for commercial purposes, including but not limited to advertising, increasing readership and page views;

(2) Edit, organize, assemble information content from Maxcom Tracker without permission and display it on channels other than the source page of our services;

(3) Use identification methods, including but not limited to any form of special identification, code, etc., to assist third parties or independently influence the information content of our services, e.g. by reading, transmitting and intercepting our traffic;

(4) Other unlawful activities aimed at obtaining or using information content from Maxcom Tracker.

6.2 With our written consent, your activities involving the sharing and forwarding of information content from Maxcom Tracker must meet the following specifications:

(1) Important data obtained through indexing and statistics, such as keywords, hit rates, categories, searches, hits, reads, etc., may not be published, made available or disclosed to any third party in any way without our prior written consent.

(2) You may not make any changes to the source pages of our Services, including but not limited to the home page link (profile page) and advertising system. You may also not block, frame, pop-up, or otherwise display the source pages of our Services in any way;

(3) Safe, effective and stringent measures must be taken to prevent third parties from illegally obtaining information content from our services through any form, including but not limited to spider programs;

(4) You shall not use the relevant content of the data for purposes beyond the scope of our written consent, such as sale and commercial use, or disclose, make available or allow third parties to use it in any way;

(5) Sharing, forwarding and copying the content of our service information to third parties must comply with other codes and standards established by us.

  1. Default handling

7.1 In the event of a violation of this Agreement or other Terms of Service, we have the right to exercise our independent judgment and take appropriate measures, such as early warnings, refusal to publish, immediate cessation of information transmission, removal of follow-ups, prohibition of short-term posting, and limitation of some or all account functions until the account is permanently closed. We have the right to report the results of the processing and decide whether to reinstate the relevant user account based on the actual situation. We will report records that indicate violations of laws and regulations and suspected criminal offenses to the relevant competent authorities in accordance with the law and will cooperate with the relevant competent authorities in conducting investigations.

7.2 If you breach this Agreement or other Terms of Service and cause a claim or lawsuit against a third party, you are solely responsible for it. If we or our partners indemnify a third party or are penalized by a governmental authority because of your illegal, breaching, or violating this Agreement, you must fully compensate us and our partners for any losses we incur.

7.3 Maxcom Tracker respects and protects users' rights to intellectual property, reputation, name, privacy, and other legal rights. You must ensure that texts, photos, videos, audio, links, etc. submitted while using our services do not infringe upon third-party intellectual property rights, reputation, name, privacy, or other legitimate rights and interests. Otherwise, we have the right to remove allegedly infringing content upon notification from legal entities or related parties. You are solely responsible for any third-party claims; if we or our partners suffer any losses (including economic losses, business reputation, etc.) due to your wrongful act, you must fully compensate us and our partners for any losses we incur.

8. Changes, interruptions and termination of services

8.1 We hope you understand that our services are provided in accordance with existing technologies and conditions. We will make every effort to ensure the continuity and security of our services. However, we cannot predict or prevent other risks that may result in service interruptions, inability to use our services, or other losses and risks at any time, including, but not limited to, force majeure, network failures, defects in third-party services, third-party websites, and others.

8.2 In order to meet the security needs of the platform's operation, in accordance with certain conditions, we have the right to determine the settings and scope of services/functions, modify, interrupt, suspend or terminate the provision of our services.

9.Advertisements

9.1 When you use our services, we may send you relevant information, advertising or branding services, and display commercial and promotional information (including commercial or non-commercial information) from our software and/or from third party suppliers and partners on Maxcom Tracker.

9.2 When using Maxcom Tracker, we will send you targeted advertising based on your preferences, interests, and so on. You can disable targeted advertising in the Maxcom Tracker settings. If you do, the ads you see will remain the same, but the number of relevant ads you see will be reduced. Read more in our Privacy Policy.

9.3 We will advertise and promote the related services in accordance with the law, and you must evaluate and be responsible for the authenticity and reliability of advertising or promotional information. Except as expressly provided by law and regulation, you are solely responsible for any purchases, transactions, or damages or losses incurred as a result of advertising or promotional information, and we are not liable for them.

  1. Intellectual property

10.1 We own the intellectual property rights in the content provided on our Services (including, but not limited to, software, technology, programs, websites, text, photographs, images, audio, video, graphics, layout, electronic documents, etc.). We also own the copyright, patent rights, and other intellectual property rights in the software we provide. No one may use the content on our Services (including, but not limited to, monitoring, reproducing, distributing, displaying, mirroring, transmitting, downloading through any robot or spider program or device) without our consent.

10.2 Any text, photos, videos, audio recordings, etc. uploaded while using our services were originally created by you or legally authorized by you. The intellectual property rights in any content you upload or publish via Maxcom Tracker belong to you or the original copyright holder.

10.3 In order to continually improve and provide better services, you agree that the content you upload, publish, transmit, or distribute (including, but not limited to, text, photographs, images, audio files or music, sound, dialogue in videos and/or audio files) on our Services is authorized by us and our partners, subsidiaries, successor companies, and we have worldwide, royalty-free, non-exclusive, and sublicensable rights (through multiple tiers), including, but not limited to, the rights of reproduction, network transmission, adaptation, compilation, modification, translation, derivative works, performance, and display). The scope of use includes, but is not limited to, current or other websites, applications, products or terminal devices, etc. You hereby acknowledge and agree that the grant of the above rights includes the following rights and licenses: the content, any promotions, advertising, and/or related marketing related to Maxcom Tracker and/or the Company brand, and otherwise developed content (in whole or in part). To be clear, you agree that the authorization of the above rights includes the permitted use, reproduction, display, transmission of your personal image, portrait, name, trademark, service mark, brand, name, logo, company logo and other materials, etc.

10.4 You agree to authorize us to act on your behalf or to entrust a professional third party with the infringement of intellectual property rights that you submit and publish, including, but not limited to: monitoring infringements, sending protective letters, filing lawsuits or In the event of arbitration, mediation, conciliation, etc., we have the right to make decisions on matters of protection of rights and implement them independently

10.5 We provide technical support for the development and operation of Maxcom Tracker and have all rights, to the extent permitted by law, to all data and information generated during the development and operation of our services.

11.1 Our services may be affected or disrupted by various factors and we cannot guarantee (including, but not limited to):

11.1.1 Our services are fully adapted to all user requirements;

11.1.2 Our services will be uninterrupted, timely, secure, reliable and error-free; any software, services or other materials you receive from us will meet your expectations;

11.1.3 Any errors in our services will be corrected.

11.2 If you suspect that you have accessed loan information or other online data related to real estate, account passwords, advertisements, or promotions, please consider this carefully and act accordingly. We assume no liability for any loss of profit, business reputation, data loss, or other tangible or intangible losses you may incur.

11.3 When using our services, you may encounter factors such as force majeure (this means objective events that cannot be predicted, overcome and avoided), including, but not limited to, natural disasters (such as floods, earthquakes, typhoons, etc.), government actions, wars, strikes, riots, etc. If this happens, we will try to remedy the damage as quickly as possible, and we will be exempt from liability for losses caused by force majeure to the extent permitted by law.

11.4 We reserve the right to deal with illegal content in accordance with our agreement. This right does not constitute an obligation or commitment on our part. We cannot guarantee that we will detect illegal activity in a timely manner or deal with it appropriately.

11.5 We do not provide any express or implied warranties or conditions regarding our services, including but not limited to commercial availability, fitness for a particular purpose, etc. You alone are responsible for the risk associated with using Maxcom Tracker.

11.6 This agreement is intended to ensure compliance with national laws and regulations, maintain social order, and protect the legitimate rights and interests of others. We will make every effort to make decisions in accordance with relevant laws and regulations to the extent possible. However, this does not guarantee that our decisions will be fully consistent with the decisions of judicial and administrative authorities. If we do, you will be solely responsible for the consequences.

11.7 In no event will we be liable for any indirect, consequential, punitive, incidental, or special damages, including losses incurred while using our services. Regardless of the cause, our total liability will never exceed the amount you paid us for using our services during your membership period.

  1. Special agreements for individual and external services

12.1 Our services contain information or links to information content obtained by Maxcom Tracker through various legal means, as well as other individual services legally operated by us and/or our affiliates. You may enable and use the individual services described above on Maxcom Tracker. Some individual services may require you to accept agreements specifically drafted for this purpose or other policies that bind you and the individual service provider; where applicable, these agreements and policies are prominently displayed to you when you plan to use the service listed above for your review and consent. By using the above services, you are deemed to have accepted the limitations of the applicable agreements and policies for the individual services. If the terms of use are not specified or are stated as "permanent," "perpetual," or "unlimited," then the terms of use for those products or services apply from the date you begin using the product or service until the date the product or service is offline on Maxcom Tracker.

12.2 When you use our services provided by a third party on Maxcom Tracker, in addition to complying with this agreement and our applicable policies, you may also be required to accept and comply with the third party's agreement, privacy policy, and applicable policies. If a dispute, loss, or damage caused by the third party software and related services is resolved between you and the third party, we will not be liable to you or the third party.

  1. Terms of Use for Minors

13.1 If you are a minor (under 18 years of age), you should read this agreement carefully under the supervision and guidance of your legal guardian and obtain verifiable consent from your parent or legal guardian before using our services.

13.2 We attach great importance to the protection of personal data of persons under 18 years of age. Minors should increase their awareness of personal data protection and take it seriously when providing personal data and only use our services on the instructions of their legal guardians.

13.3 Minors understand that in the event of a breach of the law or the provisions of this agreement, you and your guardian will bear all legal liability that may arise in this respect.

13.4 Special instructions for underage users:

13.4.1 Teenagers use our services under the supervision of their guardians. They should learn to use the internet responsibly, avoid using the virtual internet, and practice good surfing habits.

13.4.2 Minors must comply with the provisions of the National Youth Convention within the Civilizations Network:

(1) Study well online and don't look at bad information;

(2) Communicate honestly and do not offend others;

(3) Raise awareness of the need for self-defense and do not meet friends online without a reason;

(4) Maintain network security without disrupting it;

(5) Take care of your physical and mental health by not using the virtual Internet.

13.5 To better protect the privacy rights of minors, we must remind you to be cautious when posting content containing sexually explicit material. By posting such content, you are deemed to consent to our Services displaying information about minors, portraits, sounds, etc., and to permit us to use and process content related to minors in accordance with this Agreement.

14.Other

14.1 This Agreement, which has been created, entered into, performed, and disputes resolved, shall be governed by the laws of China. If any provision of this Agreement is found to be invalid or unenforceable due to conflicts with Chinese law, these terms will be rewritten to reflect the original provisions of this Agreement as closely as possible, and the remaining provisions of this Agreement will remain in full force and effect.

14.2 This contract is signed in Baoan District, Shenzhen, China. If you have any disputes with us regarding this contract, both parties should try to resolve them through friendly negotiations; if unsuccessful, you agree that the relevant disputes will be referred to the people's court in the place where this contract is signed for settlement.

14.3 To provide you with better services, our services will be updated and changed from time to time due to national laws, regulations, and policy changes. We will amend this Agreement accordingly, and these changes will be incorporated into this Agreement. If updated, we will release an updated version of Maxcom Tracker and notify you of the updated content before the updated terms take effect, so you can review the latest version of this Agreement in a timely manner. You can also review the latest version of the "Terms and Conditions" on the software settings page. By continuing to use our services, you agree to accept the amended Agreement.

If you have any objections to the revised terms, please stop logging in or using our services immediately. If you continue to log in or use our services, you will be deemed to have read and accepted the revised terms.

14.4 The headings used in this agreement are for convenience of reading only and shall not affect the meaning or interpretation of any provisions of this agreement.

14.5 Both parties are independent entities and in no event shall this Agreement create any form of express or implied warranty or condition as to our representation or interests towards you, nor shall the parties create any agent, partnership, joint venture or employment relationship.
