User Agreement – Maxcom Tracker eSIM
1. Introduction
This User Agreement (“Agreement”) governs the use of the Maxcom Tracker eSIM application and related services. Before registering an account or using the app, please read this Agreement carefully. By registering, logging in, or using the app, you confirm your acceptance of all terms and conditions.
If you do not accept these terms, you may not use the app or its services. Users under the age of 18 should review this Agreement under the supervision of a legal guardian.
2. Scope of Services
The Maxcom Tracker eSIM app provides:
- GPS and Wi-Fi location tracking,
- voice and video calling,
- chat messaging,
- remote device management,
- content sharing and social interaction.
Services may be updated, expanded, or modified without prior notice. You may choose to accept or reject updates; however, rejecting updates may limit access to certain features.
3. Account Registration
- Users register using a phone number and set a password.
- Accounts must comply with legal standards. It is prohibited to impersonate others, use offensive usernames, or register accounts in bulk.
- Accounts may not be transferred, rented, or sold without written consent from the provider.
- Users are fully responsible for all actions taken through their account.
- If you lose access to your account, recovery is possible via phone number verification.
4. Personal Data Protection
- Personal data (e.g., name, phone number, location) is collected during registration and use.
- Data is processed in accordance with the Privacy Policy and applicable laws.
- Users have the right to access, correct, delete their data, and withdraw consent.
5. User Content
Users agree not to publish content that:
- violates laws (e.g., incitement to violence, pornography, hate speech),
- infringes on the rights of others (e.g., image, privacy, intellectual property),
- is misleading, offensive, or spam.
The provider reserves the right to remove violating content and block accounts that breach this Agreement.
6. Intellectual Property Rights
- Users confirm they own the rights to any content they publish.
- Users grant the provider a non-exclusive, perpetual license to use such content within the app and related services.
7. Risk and Liability
- Services may be temporarily unavailable due to technical issues or external factors (e.g., network failures, force majeure).
- The provider is not liable for losses resulting from service interruptions.
- Users use the app at their own risk and agree to comply with applicable laws.
8. Advertising and External Content
The app may include advertisements and content from third-party partners. Users are responsible for their purchasing decisions and interactions with such content.
9. Changes to the Agreement
The provider reserves the right to update this Agreement. Users will be notified of changes via the app or website. Continued use of the app after changes implies acceptance of the updated terms.
10. Final Provisions
- This Agreement is governed by Polish law.
- Disputes will be resolved by the court competent for the provider’s registered office.
- If any provision of this Agreement is deemed invalid, the remaining provisions shall remain in effect.
